1. Identity of the Parties
On one part, Jucade Solutions SL (hereinafter, “HanaMind”), with VAT ID B19376557 and address at Avenida De Los Manantiales 24, Planta 6ª, Apartamento, 29620, Torremolinos (Málaga), Spain. On the other part, the User, natural or legal person who contracts HanaMind’s management services.
2. Object of the Service
HanaMind provides a cloud software platform (SaaS) designed for the integral management of psychology practices, which includes scheduling, patient management, electronic health records, video calls, invoicing, and secure document storage.
3. Registration and Account Use
To use the service, the User must register and maintain an active account.
- The User is responsible for the veracity of the data provided.
- Access credentials are personal and non-transferable.
- The User undertakes to notify immediately any unauthorized use of their account.
4. Economic Conditions
The service is provided under subscription models (monthly or annual).
The prices in force are those published on the website at the time of contracting.
Payment will be made by credit card or the methods enabled on the platform.
You can cancel your subscription at any time, effective at the end of the contracted period.
5. Intellectual Property
HanaMind owns all intellectual and industrial property rights over the software, design, source code, and contents of the platform. The User receives a limited, non-exclusive, and revocable license to use for the management of their practice. In no case are ownership rights over the software transferred to the User.
6. Obligations regarding Health
Important Notice
The User, as a mental health professional, is the sole Data Controller of their patients’ clinical data. The User undertakes to collect the necessary consents and comply with the health regulations applicable in their jurisdiction. HanaMind provides the technical tools but does not supervise the User’s deontological or legal compliance with their patients.
7. Availability and Support
HanaMind strives to guarantee a service availability of 99.9%. However, access may be occasionally interrupted by scheduled maintenance tasks or force majeure causes. Technical support is provided preferentially via email and chat during established hours.
8. Applicable Law and Jurisdiction
These Terms of Use are governed by Spanish law. For any controversy that may arise, the parties submit, waiving any other forum, to the Courts and Tribunals of the city of Málaga (Spain).
